What Is a 510(k)?
A 510(k) Premarket Notification is the most common FDA submission pathway for medical devices.
To obtain clearance, the manufacturer must demonstrate that the new device is substantially equivalent to a legally marketed predicate device with respect to:
- Intended use
- Indications for use
- Technological characteristics
- Performance
- Safety
- Effectiveness
For many Class II devices, the 510(k) pathway provides the shortest route to market.
What Is a De Novo Request?
The De Novo pathway was created for innovative devices that do not have a legally marketed predicate, yet present only low or moderate risk.
Instead of demonstrating substantial equivalence, the manufacturer must establish that the risks can be adequately controlled through:
- General controls
- Special controls
- Appropriate performance testing
- Labeling
- Risk management
Once FDA grants a De Novo Request, the device type receives a new classification regulation and product code. Future manufacturers of substantially equivalent devices may often use the 510(k) pathway instead of submitting another De Novo Request.
What Is a PMA?
A Premarket Approval (PMA) application is FDA’s most rigorous review process and is generally required for Class III medical devices.
These devices typically:
- Support or sustain human life
- Are implanted for extended periods
- Prevent significant impairment of human health
- Present a potentially unreasonable risk if they fail
Unlike a 510(k), a PMA requires manufacturers to independently demonstrate that the device is safe and effective using valid scientific evidence.
Because of the volume of information required, PMA applications generally require substantially more time and resources than either a 510(k) or De Novo Request.
How Do You Determine Whether a Predicate Device Exists?
One of the first regulatory activities should be conducting a comprehensive predicate device search.
A suitable predicate should have:
- The same intended use
- Similar indications for use
- Comparable technological characteristics
- Similar performance and safety profile
Finding a device with a similar appearance is not enough. FDA evaluates whether the technological differences raise new questions regarding safety or effectiveness.
If an appropriate predicate cannot be identified, the regulatory strategy may shift toward either a De Novo Request or a PMA, depending on the device’s risk classification.
For this reason, a thorough regulatory assessment early in product development can save months of unnecessary work.
Human Factors and Usability Continue to Receive Increased FDA Attention
Manufacturers should also recognize FDA’s continued emphasis on human factors engineering and usability.
Devices intended for use by healthcare professionals, caregivers, or patients should incorporate usability considerations early in product development. Manufacturers should document user needs, identify critical tasks, evaluate use-related risks, and determine whether human factors validation testing is necessary.
Addressing these expectations early can help reduce the likelihood of receiving additional information requests during FDA review.
